LEGAL OPINIONS:

  • Respond to oral and written requests for legal opinions.  The legal opinions should specifically address and answer the questions raised and be based on careful research, discussions with all persons having relevant information, and an exploration of underlying relevant facts.


PREVENTATIVE LAW:

  • Seek out and identify potential legal problems for the Agency for Health Care Administration.  Present identified problems along with any proposed legal advice to the AHCA General Counsel's Office.  This should be accomplished by participating in an agency consultant role to office personnel and groups, reviewing documents, rules, manuals, and proposed and existing legislation.


LITIGATION:

  • Represent AHCA in litigation in all matters, which may include but are not limited to Medicaid fraud and abuse, Medicaid overpayment, licensure and certification, certificate of need, contracts, and personnel.  Such representation may be in all forums, including but not limited to: (a) Public Employees Relations Commission, (b) state trial and appellate courts, (c) federal trial and appellate courts, and (d) state and federal administrative bodies.  In the course of litigation, keep in close contact with all personnel affected by the suit.  Office personnel should be informed at all major decision points, and copied with all significant pleadings and memoranda filed and received.  Prepare all necessary legal documents.
  • The facts and law for each case should be thoroughly researched.  During the course of litigation, the ultimate goal is to facilitate the Agency’s delivery of human and social services and protecting the public interest.

 

KNOWLEDGE, SKILLS, AND ABILITIES:

  • Demonstrated legal research and writing skills.
  • Knowledge of the Medicaid program.
  • Knowledge of civil and/or administrative litigation procedures; familiarity with administrative rulemaking; and, computer skills. 
  • In addition: strong oral and written communication.
  • Organizational abilities.
  • Effective time management.
  • Ability to work either independently or collaboratively, as required.

 

MINIMUM QUALIFICATIONS:

  • Admission to the Florida Bar with membership in good standing; and at least three (3) years of professional experience in the practice of law, legal research and writing, judicial and legal clerk or internships, teaching law or in administrative judicial hearings.

 

LICESENSURE, CERTIFICATION, OR REGISTRATION REQUIREMENTS:

  • Florida Bar licensure
