The Office of the General Counsel within the Agency for Health Care Administration is looking to fill senior attorney positions. The attorney provides legal representation for the Agency's licensure and regulatory programs before the Florida Division of Administrative Hearings and other forums pursuant to Chapter 408, Florida Statutes. The primary focus of this position is administrative litigation.
Under the supervision of the General Counsel, Deputy General Counsel and Chief Legal Counsel, the attorney applies legal expertise to handle administrative litigation, research federal and state facility licensure and regulation issues, conduct legal discovery, and prepare legal pleadings and motions. The attorney must be able to assimilate and analyze a variety of legislation and legal concepts relating to facilities licensure and regulation issues.
Examples of Work Performed:
Prosecutes administrative litigation before the Division of Administrative Hearings throughout Florida regarding the licensure and regulation of licensed health care and residential facilities, including but not limited to, hospitals, nursing homes, assisted living facilities, home health agencies and health care clinics.
Prosecutes administrative and civil litigation regarding the unlicensed practice of health care and residential facilities.
Prepares and drafts routine pleadings, briefs, agreements, and related legal documents pertaining to facilities regulation and licensure.
Provides legal counsel on legal matters related to the licensure and regulatory programs; interprets state and federal legislation related to facilities regulation matters.
Performs legal research concerning the interpretation of federal and state law, primarily the Florida Statutes and the Florida Administrative Code on health care facilities licensure and regulation.
Supervision of assigned administrative staff.
Performs other related duties as required.

MINIMUM QUALIFICATIONS REQUIREMENTS
Active member in good standing of the Florida Bar with minimum of two years professional experience in the practice of law, legal research, teaching law, or in administrative or judicial hearings.
Preference given to Spanish speaking candidate.
Preference given to candidate with litigation experience.
