This is responsible work determining the eligibility for employment or service provision to vulnerable clients. It requires frequent interaction with Legal, Human Resources, the court system, law enforcement agencies and community providers. The work requires an ability to analyze detailed reports and records and recommend appropriate disposition.

  • Assure accurate and timely implementation of fingerprinting and background screening for all specified employees and caretakers in the Department as well as those owners, operators and employees of community programs that must be screened under Florida Statutes, Sections: 39.001(2) Department contracted services for children. 110.1127 State positions "of special trust and responsibility". 393.655 Developmental Disabilities Programs 394.4572 Mental Health services that serve children 397.451 Substance Abuse services that serve children and D.D. clients 402.305(1) Child Care Centers 402.313 Family Child Care Homes (Licensed and/or Registered) 409.175 Family Foster Homes; Residential Child Caring Agencies; Child Placing Agencies and Summer Camps
  • Reviews criminal history records. Obtains supporting or clarifying documentation through court jurisdictions regarding potentially disqualifying offenses where indicated.
  • Determines disqualifying offenses based on statutes and rule. Consults with General Counsel as needed to ensure compliance where indicated.
  • Prepares appropriate notification documents to employee, caretaker, agency, and advises of appeal rights.Ensures unit compliance with Departmental policies and operating procedures related to background screening.
  • Conducts abuse history checks for various programs, including but not limited to: Developmental Disabilities providers, Foster Care and Group Care Licensing, Child Care Licensing, private Adoptions and Adult Services providers.
  • Provides training and technical assistance on background screening law and process for Department staff and community providers.
  • Receives and reviews all requests for exemption to ensure timely and accurate submission.
  • Oversees exemption review process. Prepares materials and summary of background and rationale for decision-makers.
  • Works with Human Resources, Contract Performance Unit, Program Offices, as well as Licensing staff to interpret criminal history information and its implications for employees, licensees, contractors, applicants, etc.
  • Notifies applicant and employer, if required, of exemption results. Provides for administrative appeal.
  • Reviews requests for administrative appeal hearings.
  • Works with General Counsel to prepare for any appeals hearing.
  • Works with General Counsel to respond to public records requests as appropriate.
  • Performs other duties as assigned.
