The Agency is seeking to fill an OPS Senior Legal Assistant to provide informal hearing representation regarding licensure unit cases. 

 

Duties and responsibilities are listed below:

INFORMAL HEARING REPRESENTATION REGARDING LICENSURE UNIT CASES:

The Senior Legal Assistant represents the Agency in informal administrative proceedings concerning Notice of Intent issued by the HQA license units. 

The Notices of Intent include the denial or withdrawal of license applications and sometimes the imposition of minor administrative fines. 

The representation is limited to cases where the provider has requested an informal hearing, and the case has been assigned to an Agency informal hearing officer. 

In such cases, the provider is not disputing issues of material fact, but is seeking to amicably resolve licensure issues, typically the completion of license applications. 

The Senior Legal Assistant must have or develop a thorough understanding of the licensure process for health care facilities as well as the administrative review process under the laws for license applications. 

The Senior Legal Assistant is expected to learn the statutes regarding licensure (Chapter 120 and Chapter 408, Part II) as well as the various authorizing statutes, the corresponding administrative rules and corresponding license application forms. 

In addition to substantive legal knowledge, the Senior Legal Assistant is expected to have listening skills, patience and superior negotiation skills. 

The ability to work with applicants regarding the application process can be difficult and challenging at times. 

The Senior Legal Assistant may be requested to prepare some types of legal documents, including template settlement agreements, final orders and routing slips. 

 

CIVIL AND ADMINISTRATIVE LITIGATION: 

The Senior Legal Assistant may be requested to assist attorneys with the preparation of document discovery for civil and administrative litigations. 

Discovery consists primarily of email retrieval by working with the Agency’s Information Technology department and document review to protect privileged and confidential information. 

The document review may also be the result of public records request. 

 

GENERAL INQUIRIES BY THE PUBLIC, AGENCY PERSONNEL AND OTHER GOVERNMENT PERSONNEL: 

The Senior Legal Assistant responds to general inquiries by the public and other agencies regarding possible issues about licensure. 

Senior Legal Assistant is expected to provide answers in a polite and professional manner.   

 

This position will be filled at $35.00 hourly and is non-negotiable.

 

SUCCESSFUL COMPLETION OF A BACKGROUND INVESTIGATION IS A CONDITION OF EMPLOYMENT.

Knowledge of Florida laws and legal procedure.

Ability to perform legal writing and prepare various legal documents.

Ability to research legal documents and legal references.

 

MINIMUM QUALIFICATIONS REQUIREMENTS

Five (5) years’ experience as a Paralegal or Legal Assistant.
