Our Organization and Mission:
The Reemployment Assistance Appeals Commission, also referred to as “RAAC” or the “Commission,” is the quasi-judicial administrative appellate body responsible for reviewing contested decisions of FloridaCommerce hearing officers. The Commission is comprised of a Chairman and two Commissioners, each appointed by the Governor, and confirmed by the Senate, and is 100% federally funded. The Commission is housed within FloridaCommerce; however, it operates as an independent review body.
The Work You Will Do:
This is a highly responsible professional position exercising a high degree of independent judgment and discretion. The employee will review the records of formal administrative proceedings conducted by FloridaCommerce hearing officers and make a recommendation to the Commission on the disposition of the cases, including preparation of draft Commission orders. The employee must be cognizant of the importance of federal and state-imposed deadlines, and organize work to ensure that deadlines are met.

You will help to ensure that the dispositions of reemployment assistance appeals are legally correct, both substantively and procedurally, and are processed in accordance with state and federal timeliness standards.

This position provides an opportunity to develop legal skills and experience, foster working relationships with reemployment assistance professionals, and obtain experience working for a quasi-judicial administrative entity. RAAC provides extensive in-house training and also encourages its employees to take advantage of FloridaCommerce and USDOL trainings, which are made available throughout the year, as well as Florida Bar continuing legal education courses.

Your Specific Responsibilities:
Under the direct supervision of a Commission Executive Senior Attorney, this employee can be expected to perform the following duties:
Analyze complex disputed reemployment assistance appeals pending before the Commission. Review the record of formal administrative hearings conducted pursuant to Chapter 443, Florida Statutes. Conduct independent legal research and exercise independent judgment in determining: whether the hearing was conduct in accordance with the requirements of due process; whether the hearing officer’s findings of fact are supported by legally sufficient evidence; and whether the conclusions of law are in accord with statutory and regulatory provisions of law as interpreted by the Commission and state and federal courts. Prepare a summary of the case that includes a professional legal opinion with respect to its disposition by the Commission. Prepare drafts of orders which will constitute final administrative agency action by the Commission.
The incumbent will be expected to provide general legal advice and assistance to the Commission.
The incumbent will occasionally be expected to handle telephone inquiries from the public regarding pending appeals and general reemployment assistance law.

Required Knowledge, Skills, and Abilities:
Excellent legal research and writing skills.
Ability to establish and maintain effective working relationships with others.
Ability to exercise discretion and confidentiality in handling matters before the Commission.
Working knowledge of Microsoft Outlook and Microsoft Word.
Ability to work independently.
Attention to detail.
Qualifications:
Bachelor of Law Juris Doctor from a law school accredited by the American Bar Association. Also requires membership in the Florida Bar in good standing.
As a condition of pre-employment eligibility, a Level 2 security background screening is required, which consists of fingerprinting and a check of local, state, and national law enforcement records.
