Position Summary

This Fair Hearing Attorney position is under the direct supervision of the Attorney Supervisor, in the Office of the General Counsel, and provides legal representation to the Agency for Persons with Disabilities (Agency) in the area of consumer services and supports and Medicaid-related litigation in various forums before the Department of Children and Families Office of Appeal Hearings, the Division of Administrative Hearings, as well as other state or appellate courts, as required.

 

The Work You Will Do 

The Fair Hearing Attorney will represent the Agency’s regional and state office staff who determine program eligibility and levels of services and supports for the Home and Community-Based Services (HCBS) iBudget Waiver program, and related Medicaid determinations by the Agency, for individuals with qualifying developmental disabilities. The Fair Hearing Attorney will analyze Waiver legal issues and provide legal advice and guidance. The Fair Hearing Attorney will provide training to Agency staff as needed on Waiver procedures and hearings.

 

The Fair Hearing Attorney’s representation of the Agency shall be conducted with a high degree of professionalism. The Fair Hearing Attorney shall exercise sound independent professional judgment, with a minimal amount of supervision, in a manner that is timely, well-researched, thorough, and diligent.

 

The Fair Hearing Attorney shall perform a variety of complicated legal services, including analyzing legal issues, providing sound legal advice and guidance on complex Agency issues, and timely responding to oral and written requests from Agency personnel, as directed by the Attorney Supervisor, or other OGC leadership. In providing legal advice to the Agency, the Fair Hearing Attorney shall adequately explore the underlying facts, engage in discussions with appropriate staff, carefully research the law, as applicable, to furnish proper legal guidance to the Agency.

 

The Fair Hearing Attorney shall conduct legal research, interpret statutes, review regulations, rules, relevant handbooks, operating procedures, as necessary, to carry out professional duties and responsibilities in advising the Agency in legal matters.

 

The Fair Hearing Attorney will provide training to Agency staff as needed on relevant procedures and hearings. The Fair Hearing Attorney is required to manage the administrative tasks associated with this position such as scheduling hearings, maintaining calendars, preparing evidence packages, coordinating witnesses, et cetera.

 

The Fair Hearing Attorney is required to travel, as needed.

 

The Fair Hearing Attorney may also be required, as directed by the Attorney Supervisor, or other OGC leadership, to:

· Handle other cases besides Fair Hearing Cases.

· Prepare reports.

· Travel.

· Perform other duties, as needed.

Knowledge, Skills, And Abilities

Knowledge of:

  • Legal terminology.

 

  • Florida laws and legal procedure, including administrative procedures and practices.

 

  • Public records and their exemptions, HIPAA, Medicaid, and laws and ethics in government. (Preferred)

 

 

  • Knowledge of Microsoft Office software (Outlook, Teams, PowerPoint, Excel, and SharePoint) and Adobe Acrobat.

Ability to:

  • Provide legal counsel and represent the Agency at the administrative and appellate level.

 

  • Perform legal research and prepare various legal documents.

Background Screening Requirement

It is the policy of the Florida Agency for Persons with Disabilities that applicants for employment undergo Level 2 employment screening in accordance with the requirements of Chapter 435, Florida Statutes, as a condition of employment or being permitted to serve as a volunteer.
