POSITION SUMMARY:

The Florida Department of Law Enforcment (FDLE) is seeking to fill a Senior Attorney position within the Office of General Counsel (OGC) in Tallahassee, Florida. The OGC works closely with the department’s Command Staff, regional Special Agents in Charge, and Program Directors to provide legal assistance and advice that is responsive to the specialized needs of the department, region or division.

 

The OGC serves the entire agency in many different capacities such as advising agents regarding ongoing criminal investigations and criminal intelligence gathering, arrest and search warrants, and interception of oral communications. The OGC also provides legal support to the various program areas within the department as well as providing training on a variety of criminal law and procedure topics for FDLE’s Special Agents.

 

DUTIES & RESPONSIBILITIES:

Primary responsibilities are representing FDLE in "Officer Discipline" actions, including hearings at the Division of Administrative Hearings, on administrative license discipline cases involving law enforcement, correctional, and correctional probation officers. Working in a team of three prosecuting attorneys, evaluating cases for probable cause, as well as proceeding with license disciplinary actions, presenting the case through witnesses and evidence before an Administrative Law Judge, arguing in favor of proposed findings of fact and imposition of a disciplinary penalty, effectively presenting cases for final agency action before the 19-member Criminal Justice Standards and Training Commission, (CJSTC) and must handle any appeals on his or her cases. The incumbent also provides legal services and advice to the staff of the FDLE Criminal Justice Professionalism Division, which supports the CJSTC's efforts.  The incumbent will occasionally be assigned legal training and presentation responsibilities.

 

NOTE:  Incumbent is based in Tallahassee in the FDLE Headquarters Building. Frequent in-state travel by car is required. Occasionally, there may be multiple hearings combined in one road trip.

 

To be considered as a potential candidate, you must meet the minimum qualifications(s) listed below. Degrees must be from an accredited college or university as recognized by the U.S. Department of Education.

 

MINIMUM QUALIFICATIONS:

  1. A member of the Florida Bar for two or more years and a minimum of two years legal work experience.

 

PREFERRED QUALIFICATIONS:

Legal work experience as a Florida prosecutor (Assistant State Attorney or Assistant Statewide Prosecutor); Preference will be given to candidates with Florida criminal law experience.   

 

SALARY:

  • $80,000.00 to $95,000 Commensurate with Experience

BACKGROUND:

FDLE requires an extensive background process of all recommended applicants.
